Sale of property because of unpaid taxes

Municipalities are required by law to collect taxes.

With that rule in mind, under articles 1022 and beyond of the Municipal Code of Québec (L.R.Q., chapter C-27.1), when taxes go unpaid, a municipality can put the property in question up for sale; this recourse allows the municipality to recover the taxes and duties listed on its collection roll, specifically:

  • property taxes
  • duties on transfers of immovables (real-property transfers);
  • all other tax-related debts.
